E-Discovery Readiness
The rising costs of e-discovery are concerning to corporations and legal professionals alike, especially during this economic downturn. In response to requests from our clients, we have developed an E-Discovery Readiness Assessment to help dramatically reduce your e-discovery costs. This E-Discovery Readiness Assessment determines a company’s level of litigation preparedness. We thoroughly investigate a company’s current record management program, determine the most likely litigation events they would experience, and then rank their e-discovery risks accordingly. Our final report contains recommendations for simple and affordable ways to maintain control over thousands of documents in preparation for e-discovery. Many companies discover hidden areas of expense only when they are amidst the e-discovery process. Many times, IT solutions implemented to streamline a company’s technology may result in difficulties during the e-discovery process. For example, tape backups are a common corporate tool for data storage and disaster recovery, but they often contain relevant information for lawsuits. The way those tapes are maintained, stored, and the data they contain will all be factors in the cost of e-discovery. Backup tapes are often requested during discovery, and the review and production of each backup tape is a very expensive proposition. However, by assessing the situation beforehand and determining the type of information most likely to be requested from that particular company, a more “e-discovery friendly” solution can be implemented. Any process that reduces the number of documents to review and produce, including the move towards more searchable or accessible technology, will substantially reduce e-discovery costs. First, we perform a pre-audit assessment of the company’s current document retention, management and RIM environment by reviewing the current procedures and controls in place. Then, the results of the study are compiled into an easy-to-read report with recommendations to mitigate the most urgent risks. This process takes into consideration the particular challenges of each company’s specific industry and the documents they create. Companies directly benefit from the assessment and recommendations since proper e-discovery readiness and litigation preparedness can save time and money during litigation.
