Program Descriptions
Social Media: ESI in the Cloud
An increasing majority of the American population uses social media to connect with their friends, relatives, colleagues, teachers, clients, and people they may have never met. Users are sharing unprecedented amounts of information including photographs, videos, and geographical data, often with few privacy settings or filters in place. This is true of the legal profession as well, since many apps are based in the cloud. Legal professionals should take into account their unique confidentiality and privilege requirements when entrusting the cloud with their firm’s and their client’s data. This presentation covers tips for keeping client information safe while enjoying the conveniences of accessible data on the cloud.

ESI: Focus on Planning & Strategy
This presentation includes strategies for controlling e-discovery costs at every stage of the process, including preservation, processing, and production. It includes steps to reduce the amount of ESI while ensuring that key information is still readily available. This presentation includes a discussion on concept clustering and predictive coding workflow.

ESI: Focus on Review & Production Strategy
This presentation discusses the intricacies of who, what, when and how of review, production, and searching for e-discovery projects. It introduces the basic search language and operators that can be used to quickly and efficiently comb through documents that may or may not be relevant. The presentation includes several suggestions for reducing expenses through early case analysis and limiting review. The presentation includes a section on the proper use of de-duplication and email threading, as well as a discussion of technology assisted review.

Focus on the Ethics of ESI
This presentation will discuss the ethics issues that arise during e-discovery. There will be a discussion of the particular ethical issues encountered at each step of ESI processing including preservation, processing, and review; this includes the duty to preserve, ethical issues involving metadata, de-duplication, and the ethical use of technology to reduce review time. The presenter will also discuss the issues of licensing that have arisen within the e-discovery field. The presentation will conclude with a discussion of the ethical use of technology, including search terms and technology assisted review.
