Hot Topics in E-Discovery and ESI: Focus on Ethics

Dr. Manes will be presenting 3 hours of CLE at the Tulsa County Bar Association on Thursday, October 31st. The presentations will be held at 1446 S. Boston Ave in Tulsa.

The day begins at 9 am with a two hour discussion of the hot topics in e-discovery. This includes an extensive discussion of the benefits and drawbacks of technology assisted review and predictive coding. Other issues include de-duplication, metadata, and a thorough discussion of the most beneficial types of searching. Dr. Manes brings a scientific approach to these issues as well as the practical knowledge gleaned from performing e-discovery processing on a daily basis.

The third hour will focus on the ethics of ESI, and this hour counts for 1 CLE Ethics hour. This presentation will discuss the ethics issues that arise during e-discovery. There will be a discussion of the particular ethical issues encountered at each step of ESI processing including preservation, processing, and review; this includes the duty to preserve, ethical issues involving metadata, de-duplication, and the ethical use of technology to reduce review time. The presenter will also discuss the issues of licensing that have arisen within the e-discovery field. The presentation will conclude with a discussion of the ethical use of technology, including search terms and technology assisted review.
